Fundamental legal aspects of power decentralization in Ukraine: concept, risks, ways of realization

Abstract

The article is devoted to modern theoretical and legal understanding of decentralization of power and the ways and risks of an embodiment of a corresponding reform of power structures in Ukraine. The author investigates two main issues, firstly the clarification of the theoretical framework of the nature and characteristics of the concept of «decentralization of power» and ways and use its implementation in the realities of Ukraine; secondly, identifying the perceived risks of decentralization that can be a useful tool to prevent possible negative consequences of decentralization of power. Relying on encyclopedic, doctrinal and historical aspects of the understanding of decentralization, the author seeks to enter the modern theoretical and legal understanding of the ways of improvement of activity of bodies of state power and bodies of local self-government in Ukraine. For this article growing understanding of the decentralization of state power, as a form of delegation of essential functions, rights and budgets from state authorities to local authorities so that more power received those bodies which are more close to the voters, to ordinary citizens, people who live in Ukraine and where these powers might exercise more effectively. At the same time in the work is determined by insufficient transfer of authority of the state of focus of reforming regulatory and legal aspects of decentralization, at a time when not enough attention is given to supporting forms of self-organization of communities.
